The Analysis of Negative Influence of Open Auctions in an Electronic Form on Business Processes in Building

Abstract

Carrying out purchases in the building sphere with application of electronic (reversive) auctions generates, as a rule, unfair competition, ruin of small and medium building business and causes huge damage to building branch of Russia. It became much more difficult to work in building branch, from branch qualified specialists are washed away, the personnel structure promptly grows old, the youth doesn’t aspire in branch, the building organizations don’t develop, don’t get new technologies and the equipment. Auctions in building branch constantly reduce qualification of workers and generate “short-lived firms”. When the lowest wins, nothing the reasonable price, requirement in the qualified performers decreases. Since January 1, 2014 the Federal law of April 5, 2013 N44-FZ “On contract system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs” came into force. The new law on contract system in many respects improved the system of purchases existing earlier and eliminated some defects. But basic problems of a choice of contractors aren’t overcome. In article negative effects of the modern legislation on government purchases in building are considered, the directions of their overcoming are offered.
