On the Some Methods of Protection of Intellectual Property Rights (Customs Aspect)

Abstract

This article raises questions, related to the activities of customs bodies in the field of protection of intellectual property. Also it addresses certain legal and practical aspects of customs activities in this field, taking into account the creation of customs union and Russia's WTO accession (WTO - World Customs Organization). Customs procedures and customs control is being discussed, in relation of goods, import of which is related to the need of protection of intellectual property rights. The author analyses the importance of using of new prevention methods in this area, including more flexible and effective use of risk management system. Separately considered logistical approaches to problems of protection of intellectual property in the field of customs. Also author in trying to forecast potential risks during performance of customs operations with goods containing intellectual property and possible movement of such goods.
